Luke Armstrong, son of former professional cyclist Lance Armstrong, has been arrested in Texas on charges of sexual assault of a child, according to an Austin police arrest affidavit.
The then-18-year-old sexually assaulted a 16-year-old girl in March 2018 after a party in Austin, according to the affidavit obtained by Texas television station KXAN (opens in new tab). The girl reported the incident in November 2020, telling police that she asked Armstrong to pick her up from the party where she had been drinking.
The victim told police that she did not remember the trip in Armstrong's truck and only remembered waking up on the couch at Armstrong's father's house and being sexually assaulted. According to the affidavit, Armstrong admitted in a December 2020 phone call that he had sex with the girl at his father's house on Windsor Road in Austin.
According to the affidavit, the Austin Police Department interviewed several individuals connected to the girl and most of those contacted stated that the girl testified that she had been sexually assaulted. One person told police that the sex was consensual.
Armstrong's attorney, Randy Leavitt, denied the allegations on behalf of his client, saying that Armstrong and the girl had already been in a consensual relationship for several months. He said he and Armstrong's family are gathering evidence to prove his innocence. [According to KXAN, Leavitt said, "What happened at the high school three years ago was not a crime and it was not sexual assault. It was consensual at the time, and the two young men continued a consensual relationship that ultimately led them to go their separate ways." These accusations should not have been made, nor should they have been made three years later.
"A complete review of the facts will confirm that what was alleged absolutely never happened. And a proper and thorough legal process would exonerate Luke.
In Texas, anyone under the age of 17 is not considered mature enough to consent to sex. However, Texas has a "Romeo and Juliet" law that allows consensual sex between teenagers over the age of 14 and teenagers under the age of 3.
However, Texas also has a law that states that anyone under the age of 16 cannot legally consent to sex if they are unconscious, asleep, or have been given a "mind-altering substance."
Leavitt added that Armstrong was granted a bail bond Tuesday, meaning he does not have to post bail, and was released.
Lance Armstrong, who won the 1993 road world championship and La Fleche Wallonne in 1996, has not publicly commented on the case during his 19-year career.
